Summary: The Council missed an opportunity to direct Mr X’s correspondence to the correct statutory review process, failed to issue a meaningful complaint response, and provided inaccurate signposting to the Housing Ombudsman. These faults caused avoidable confusion and denied Mr X a fair opportunity to have the decision reviewed. The Council has accepted our recommendations.

Summary: Mrs X complained about the Council’s actions since she approached it for assistance with homelessness in June 2023. We find the Council at fault for delays in accepting statutory duties, failure to assess whether it was reasonable for her to remain in the property, inaccuracies in her personal housing plans, and poor complaint handling. As a result, Mrs X experienced financial loss, significant distress, and avoidable uncertainty during an already difficult period. The Council has agreed to apologise to Mrs X, pay her its proposed financial remedy, and improve its services.

Summary: Mr X complained the Council failed to take enforcement action against a developer after installing defective drainage at his home, and failed to pursue the developer for making false representations. He also said the Council signed off the drainage without completing proper checks. We found no fault in the Council’s decision-making processes.

Summary: Mrs X complained the Council failed to put alternative provision in place for her child, Y who has an Education, Health and Care (EHC) Plan when they were unable to attend school between February and July 2024. This period falls outside of our jurisdiction because Mrs X appealed to the Special Educational Needs and Disability tribunal. The Council was at fault for delays in paying Mrs X direct payments after the tribunal concluded which caused a three week loss of education for Y. It also delayed responding to Mrs X’s complaint. The Council agreed to make payments to Mrs X to recognise the injustice this caused.

Summary: Mr C complained about the Council’s handling of his planning and environmental control concerns regarding a neighbouring business, including anti-social behaviour. We found no fault in the process the Council followed to reach its views, and it did not cause unnecessary delays as the matters were progressed. Mr C did experience distress, and his residential amenity was impacted, but this was therefore not due to fault by the Council. However, there was some fault in its delayed complaints handling. The Council should apologise to acknowledge the uncertainty this caused Mr C.

Summary: Mrs B complained about the Council’s handling of her son’s (X) education. The Council apologised for its poor handling of her enquiry about a personal budget, and it agreed it caused delays in the annual review process for his Education, Health, and Care plan. This was fault which caused Mrs B distress and uncertainty. However, we cannot say X experienced an injustice as a result. The Council will make a symbolic payment to acknowledge the impact its faults had on Mrs B. There was no fault on how the Council considered its alternative provision duty, and other parts of the complaint were not investigated as these were late or carried appeal rights.
