West Sussex County Council (23 012 587)
Statement Upheld Special educational needs 16-Jul-2024
Summary: Mr X complained the Council failed to provide his relative, Z, with suitable education for around two years. We cannot investigate the suitability of the education provided as Mr X appealed to the Special educational needs and disabilities (SEND) Tribunal about this. We cannot investigate his complaint that the Council failed to amend Z’s Education, Health and Care (EHC) Plan for the same reason. However, the Council was at fault for taking more than a year to respond to Mr X’s complaint. This fault caused him avoidable frustration and put him to time and trouble. The Council has agreed to apologise, pay Mr X £150 and take action to improve its complaint handling.

Based on evidence seen, we find the care provider was at fault for failing to turn up to care visits, turning up at care visits late and poor communication between teams. This caused significant distress to Mrs X. To address the injustice caused by fault the care provider has agreed to apologise, make a symbolic payment and issue a refund.

Leicester City Council (24 002 994)
Statement Closed after initial enquiries Homelessness 16-Jul-2024
Summary: We will not investigate Miss X’s complaint about the Council’s handling of her homeless case. She says the Council failed to provide her with suitable accommodation between 2019 and 2024, and that the Council failed to support her with securing private accommodation between 2022 and 2024. This is because most of her complaints are late and there are no good reasons to exercise discretion to consider the late complaints. In addition, the alleged faults have not caused any significant injustice and it is reasonable for Miss X to ask the Council to complete a review.
-
Rotherham Metropolitan Borough Council (24 002 741)
Statement Closed after initial enquiries Child protection 16-Jul-2024
Summary: We will not investigate Miss X’s complaint about the Council’s children’s service’s involvement with her family. There is not enough evidence of fault to justify our involvement and further investigation would not lead to a different outcome.

Statement Closed after initial enquiries Council tax 16-Jul-2024
Summary: We will not investigate this complaint about the Council’s use of discretion to write off a debt as the matter was appealed to a Valuation Tribunal and remedied by the Council.
-
North Somerset Council (24 002 996)
Statement Closed after initial enquiries Trees 16-Jul-2024
Summary: We will not investigate Miss X’s complaint about the Council deciding not to cut back trees near her property, not discussing the matter on-site with her, and the tree roots causing pavement damage. There is not enough evidence of fault in the Council’s decision-making process about the trees, including its site visits, to warrant an investigation. Investigation of the pavement issue would not achieve a different outcome.
