  • London Borough of Lewisham (23 019 139)

    Statement Upheld Homelessness 07-Aug-2024

Summary: Miss X complained the Council delayed repairing or replacing her front door after her son damaged it in October 2022. She said the delays caused her family distress. The Council has now fixed the door and offered Miss X £150 for her distress and putting her family at risk of harm. Miss X was not satisfied with this offer. There was fault in the way the Council did not ensure the contractor replaced the door within a reasonable timescale. This distressed Miss X and placed her family at risk of harm. The Council has agreed to apologise and make a financial payment.

  • London Borough of Newham (23 019 331)

    Statement Not upheld Homelessness 07-Aug-2024

Summary: Miss X complained about the way the Council responded to her homelessness application and about the way her landlord pursued her for rent arrears. We found there were issues with the Council’s communication and there was some delay in its actions. However, we discontinued our investigation because the Council remedied the complaint appropriately. We did not investigate the actions of Miss X’s landlord.

  • Fenland District Council (23 019 342)

Statement Not upheld Planning applications 07-Aug-2024

Summary: X complained about the Council’s decision to charge a full planning application fee for their development proposal. We found no fault in the way the Council made its planning decision.

  • Brighton & Hove City Council (23 010 104)

Statement Closed after initial enquiries Licensing 07-Aug-2024

Summary: We will not investigate this complaint about the Council’s refusal to allow Mr X’s business to revert back to the pavement licence hours he operated under pre-Covid. This is because we are unlikely to find evidence of fault by the Council sufficient to warrant an investigation.

  • London Borough of Barking & Dagenham (23 011 975)

Statement Upheld Parking and other penalties 07-Aug-2024

Summary: Mr X says the Council failed to consider his circumstances when refusing his application for a dropped kerb, relied on incorrect information and refused to consider his complaint. The Council failed to properly consider Mr X’s circumstances when refusing his application, included incorrect information in its decision letter and failed to process his appeal. An agreement to carry out a further appeal, send a reminder to officers, consider amending the Council’s guidance and refund of the application fee is satisfactory remedy.

  • Chorley Borough Council (24 004 819)

Statement Closed after initial enquiries Allocations 07-Aug-2024

Summary: We will not investigate this complaint about the Council giving housing to another person. There is not significant enough direct injustice to Mrs X to warrant investigation.

  • West Berkshire Council (24 004 895)

    Statement Upheld Disabled children 07-Aug-2024

Summary: We found fault in a previous investigation because the Council failed to consider Ms X’s complaint about a personal budget for her child, via the statutory complaints procedure for children’s social care services. The Council agreed to consider the complaint via the statutory procedure, but then failed to do so. Therefore, we opened this investigation to consider further fault causing injustice to Ms X. There was fault by the Council which further delayed Ms X in receiving a response to her complaint via the statutory procedure. The Council agreed to pay a financial remedy to recognise the distress caused by this further delay.

  • Somerset Council (24 005 962)

Statement Closed after initial enquiries Planning applications 07-Aug-2024

Summary: We will not investigate this complaint about how the Council dealt with a planning application. This is because the complainant has not suffered significant injustice as a result of the alleged fault.

  • Royal Borough of Greenwich (24 005 803)

Statement Closed after initial enquiries Councillor conduct and standards 07-Aug-2024

Summary: We will not investigate this complaint about how the Council dealt with a complaint about the conduct of a councillor. This is because we are unlikely to find fault.

  • Royal Borough of Windsor and Maidenhead Council (24 007 038)

Statement Closed after initial enquiries Leisure and culture 07-Aug-2024

Summary: We will not investigate Mrs B’s complaint that she and her dog came to harm due to the Council’s failure to maintain a green space. This is because it is reasonable for Mrs B to pursue this matter at court.
