West Suffolk Council (24 005 491)
Statement Closed after initial enquiries Planning applications 19-Sep-2024
Summary: We will not investigate this complaint about the Council’s handling of a planning application for a site next to the complainant’s home. There is not enough evidence to conclude that any fault has affected the planning outcome, so the complainant has not been caused a significant injustice.

Leicester City Council (23 001 653)
Statement Upheld Special educational needs 19-Sep-2024
Summary: Ms X complained about how the Council handled her son, Y’s Education, Health and Care (EHC) Plan and education since 2020 and how it considered her complaints about those matters. The Council delayed issuing Y’s amended EHC Plan after an annual review meeting in December 2022 and its complaint response was unclear. The Council will apologise to Ms X for the uncertainty and frustration caused to her and pay her a symbolic amount of £300. The Council will remind its staff to act in line with the timelines set out in statutory guidance for EHC Plans.

London Borough of Hammersmith & Fulham (24 004 698)
Statement Closed after initial enquiries Allocations 19-Sep-2024
Summary: We will not investigate this complaint about Mr X’s housing application. The complaint about the first application is late without good reason to investigate it now. The Council properly reached its decision on the second application. It would be disproportionate for us to investigate the time taken to decide the second application. The question of any Council responsibility for Mr X’s injury is properly for the courts, not the Ombudsman.
-
Mansfield District Council (24 010 450)
Statement Closed after initial enquiries Other 19-Sep-2024
Summary: Ms X says the Council breached her confidentiality by informing a third party on several occasions that she had complained about a licensing matter. We will not investigate. This is because this complaint does not meet the tests set out in our Assessment Code on which complaints we should investigate. It is reasonable for Ms X to complain to the Information Commissioner’s Office as it is better placed.
-
City of Doncaster Council (24 010 474)
Statement Closed after initial enquiries Other 19-Sep-2024
Summary: We will not investigate Mr X’s complaint about the Council’s management of its tenants. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. We have no remit to consider complaints about the management of social housing.
-
Swindon Borough Council (24 010 527)
Statement Closed after initial enquiries Other 19-Sep-2024
Summary: We will not investigate Mr X’s complaint about the Council’s delayed response to his subject access request. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. This complaint is best dealt with by another agency.
-
Cambridgeshire County Council (24 007 069)
Statement Closed after initial enquiries Safeguarding 19-Sep-2024
Summary: We will not investigate this late complaint about the Council’s safeguarding investigation. There is not a good reason for the delay in bringing the matter to the Ombudsman. In any event, further investigation by us is unlikely to achieve a different outcome.
-
North Lincolnshire Council (24 006 988)
Statement Closed after initial enquiries Other 19-Sep-2024
Summary: We will not investigate Mrs X’s complaint about the Council’s decision not to share information on the outcome of a complaint about her grandmother’s care. This is because there is insufficient evidence of fault by the Council to warrant an investigation.
-
Bristol City Council (24 007 052)
Statement Closed after initial enquiries Licensing 19-Sep-2024
Summary: I cannot investigate this complaint about a prosecution sought by the Council concerning a licencing matter. This is because the law prevents us from investigating the commencement of court proceeding and about what happened in court.
-
London Borough of Haringey (24 007 632)
Statement Closed after initial enquiries Council tax 19-Sep-2024
Summary: We will not investigate this complaint about the amount billed by the Council for council tax, or the complainant’s entitlement to housing benefit. This is because the complainant has a right of appeal to a tribunal over the issues raised which we consider she could reasonably exercise.
