Statement Upheld Homelessness 02-Oct-2024
Summary: Miss X complained about the Council’s actions regarding her temporary homeless accommodation, linked to costs of running a dehumidifier at one property and the suitability of a second property she later moved to. There was evidence of fault in the condition of the first property. The Council has already apologised and made payments to Miss X for electricity costs and to remedy the injustice caused by the issues. There was no fault in how the Council conducted a suitability review on the second property. I am satisfied any injustice to Miss X has already been remedied.

Statement Upheld Licensing 02-Oct-2024
Summary: Mrs B complained the Council failed to properly deal with her concerns about her neighbour running an unlicensed home boarding business for dogs and the noise disturbance this has caused. She also says the Council delayed handling her complaint about the matter. We do not find fault with the way the Council handled Mrs B’s concerns about the boarding business and the noise disturbance. However, it was at fault for its delay in responding to Mrs B’s complaint. The Council has agreed to apologise to Mrs B to remedy her injustice.

Devon County Council (23 020 178)
Statement Upheld Alternative provision 02-Oct-2024
Summary: Mrs X complained the Council delayed completing her daughter, Y’s Education, Health and Care (EHC) needs assessment in line with statutory timescales. The Council was at fault. It delayed deciding whether to issue Y with an EHC Plan within the statutory timescales, caused by a 19 week delay in obtaining Educational Psychologist advice. It then further delayed issuing Y’s final EHC Plan by 22 weeks after it received the EP advice. This caused Mrs X distress and delayed Y’s access to the specialist provision specified in the final Plan by around half a term. The Council agreed to make payments to Mrs X to acknowledge this injustice.

Statement Upheld Disabled facilities grants 02-Oct-2024
Summary: Mr X complained about how the Council decided what to include in a Disabled Facilities Grant to adapt his father, Mr Y’s, home to meet his needs. The Council was at fault for not including making two doorways wider in its list of works. We cannot investigate much of the rest of the complaint because Mr X complained to us too late.

Statement Closed after initial enquiries Direct payments 02-Oct-2024
Summary: We will not investigate Mr X’s complaint about the Council failing to provide appropriate care provision to him and for refusing his request for direct payments to allow him to employ his brother as his personal assistant. This is because some complaint matters are late and there are no good reasons to exercise discretion to consider the late complaint. In addition, there is insufficient evidence of fault.

Summary: We will not investigate this complaint about where Ms C’s adult social care needs should be met. The Court of Protection is better placed to decide such a dispute. It is stressful that Ms C may have to move, but there is not enough evidence of fault in the Council’s actions to justify an investigation.
