  • Dudley Metropolitan Borough Council (24 004 505)

Statement Upheld Special educational needs 13-Jan-2025

Summary: Miss X complained the Council failed to comply with the Special Educational Needs and Disability Tribunal decision which ordered the Council to name a specific school in her son’s Education, Health and Care Plan. We found the Council’s failure to issue a new EHC Plan as ordered by the SEND Tribunal is fault. This fault has caused Miss X and Y an injustice.

  • London Borough of Haringey (24 005 293)

Statement Not upheld Parking and other penalties 13-Jan-2025

Summary: Mr B says the Council wrongly referred a penalty charge notice debt to enforcement agents when he was still challenging the charge, failed to properly investigate his complaint about the bailiff’s actions during a visit and delayed putting enforcement action on hold. There is no fault by the Council.

  • Dorset Council (24 005 327)

    Statement Upheld School transport 13-Jan-2025

Summary: The complainant (Mrs X) said the Council had failed to provide transport for her son (Y) to the only school named in his Education Health and Care Plan. We found fault in the Council’s refusal to consider Mrs X’s request for transport assistance. This fault caused her injustice. The Council has agreed to apologise, to make a mileage allowance payment for Mrs X for the days Y attended the school and to make a symbolic payment to recognise Mrs X’s distress. The Council has also agreed to carry out some staff training and to review its school transport policy.

  • Brighton & Hove City Council (24 006 769)

Statement Closed after initial enquiries Noise 13-Jan-2025

Summary: We will not investigate this complaint about a failure to agree to inspect the complainant’s home because of alleged vibration caused by traffic. We have not seen enough evidence of fault in the Council’s actions to justify an investigation.

  • London Borough of Hounslow (24 007 833)

Statement Not upheld Disabled children 13-Jan-2025

Summary: Miss X complained about how the Council refused her application for a Blue Badge for her son. We ended our investigation into the complaint. Further investigation by the Ombudsman would not likely achieve a worthwhile outcome.

  • Lancashire County Council (24 008 289)

Statement Closed after initial enquiries Direct payments 13-Jan-2025

Summary: We will not investigate this complaint about a remedy payment from the Council impacting Miss X’s apparent financial circumstances in the following tax year. We could not achieve the outcome Miss X seeks, and it is open to her to pursue the matter via the courts, if necessary, or alternatively with His Majesty’s Revenue and Customs.

  • Staffordshire County Council (24 008 352)

Statement Closed after initial enquiries Residential care 13-Jan-2025

Summary: We will not investigate this complaint about the quality of care Mrs X’s mother received while in residential care. The issues complained about largely took place between 2020 and 2021. Given the passage of time, there is not a realistic prospect of reaching a sound, fair, and meaningful decision in the complainant’s case.

  • Hertfordshire County Council (24 008 731)

Statement Upheld Special educational needs 13-Jan-2025

Summary: The Council was at fault for a delay in deciding the support Mrs X’s daughter should receive for her special educational needs. It will make a symbolic payment to Mrs X to recognise her injustice. However, we cannot investigate Mrs X’s complaint about the quality of the Council’s assessment of her daughter’s needs, because this will be a matter for the SEND Tribunal.

  • London Borough of Lewisham (24 009 114)

Statement Closed after initial enquiries Other 13-Jan-2025

Summary: We will not investigate this complaint about the Council’s handling of Mr X’s report of an abandoned trailer in his locale. This is because an investigation will not usefully add to that already carried out by the Council or lead to a different outcome.

  • Lincolnshire County Council (24 009 666)

Statement Closed after initial enquiries Safeguarding 13-Jan-2025

Summary: We will not investigate this complaint about adult safeguarding. There is not enough evidence of faut to justify our involvement.
