The Ombudsman's final decision:
Summary: We cannot investigate this complaint about adult social care provided in Scotland.
The complaint
- Mrs K says the care provider has not refunded care fees paid in advance four days before her mother died in a care home in Scotland.
The Ombudsman’s role and powers
- We investigate complaints about adult social care providers and decide whether their actions have caused an injustice, or could have caused injustice, to the person making the complaint. I have used the term fault to describe such actions. (Local Government Act 1974, sections 34B and 34C)
- Our powers only extend to services provided in England (Local Government Act 1974, description and section 23)
How I considered this complaint
- I considered information provided by the complainant.
Final decision
- We cannot investigate Mrs K’s complaint because it is about care provided in Scotland. She may find the regulator of social care in Scotland, the Care Inspectorate, can help.
