The Ombudsman's final decision:
Summary: The Ombudsman cannot investigate Mr B’s complaint about the treatment of residents in connection with their accommodation. This is because complaints about Mr B’s accommodation provider are for the Housing Ombudsman to consider.
The complaint
- Mr B says his landlord is placing restrictions on residents who require additional space to charge wheelchairs and mobility scooters. Mr B says residents have been told they cannot charge mobility wheelchairs or scooters in corridors and are now required to keep them in their homes, which causes additional problems when manoeuvring around the home.
The Ombudsman’s role and powers
- We investigate complaints about councils and certain other bodies. We cannot investigate the actions of bodies such as private landlords. (Local Government Act 1974, sections 25 and 34A, as amended)
How I considered this complaint
- I spoke to Mr B and issued a final decision.
What I found
- Mr B is unhappy with the restrictions placed on him and other residents by his landlord.
- The Ombudsman does not have jurisdiction to consider complaints about the restrictions placed on Mr B by his landlord. The Housing Ombudsman considers complaints about accommodation providers. Information about the Housing Ombudsman can be found on the website below.
