Summary: The Ombudsman cannot investigate this complaint. This is because it concerns matters that are the responsibility of the NHS.
The complaint
- Mrs Y complains, on behalf of Miss X, about the actions of the care providers looking after Miss X.
The Ombudsman’s role and powers
- We investigate complaints about councils and certain other bodies. We cannot investigate complaints that are solely about the actions of bodies such as NHS. (Local Government Act 1974, sections 25 and 34A, as amended)

- I have read the complaint information and spoken to Mrs Y.
What I found
- Miss X’s care is funded by the NHS although the Council is involved in managing the care package.
- In these circumstances the NHS retains responsibility for all aspects of the care package, and we have no jurisdiction to investigate.
Final decision
- We cannot investigate as this complaint concerns NHS matters exclusively.
