Decision : Closed after initial enquiries

Decision date : 28 Mar 2019

The Ombudsman's final decision:

Summary: Ms X complains a member of the care provider’s staff persuaded her to take out several personal loans. The member of staff then took the money Ms X had borrowed. The Ombudsman will not investigate Ms X’s complaint because it is a matter for the police.

The complaint

  1. The complainant, whom I shall call Ms X, complains a member of the care provider’s staff persuaded her to take out several personal loans. The member of staff then took the money Ms X had borrowed.

The Ombudsman’s role and powers

  1. We investigate complaints about adult social care providers. We provide a free service, but must use public money carefully. We may decide not to start or continue with an investigation if we believe there is another body better placed to consider this complaint. (Local Government Act 1974, sections 34B(8) and (9))

How I considered this complaint

  1. I considered Ms X’s complaint and the information she provided. I also gave Ms X and her representative the opportunity to comment on a draft statement before reaching a final decision on her complaint.

What I found

  1. Ms X says a member of the care provider’s staff persuaded her to take out several personal loans. The member of staff then took the money Ms X had borrowed. Ms X says the member of staff took advantage of her. They now work for a different care provider.
  2. The role of the Ombudsman is to decide if the actions of a care provider has caused a person injustice. We do not investigate alleged crimes. These are matters for the police – not the Ombudsman. An investigation is not therefore appropriate.
