Summary: We will not investigate this complaint about the support provided to Miss X by Adult Social Care Services. This is because it is unlikely we would find fault.
The complaint
- Miss X complained that the Council are not providing her with enough support to meet her care and support needs.
- Miss X complained that this has left her in a low mood, and she has stopped eating.
The Ombudsman’s role and powers
- We investigate complaints about ‘maladministration’ and ‘service failure’, which we call ‘fault’. We must also consider whether any fault has had an adverse impact on the person making the complaint, which we call ‘injustice’. We provide a free service, but must use public money carefully. We do not start or continue an investigation if we decide there is not enough evidence of fault to justify investigating. (Local Government Act 1974, section 24A(6), as amended, section 34(B))

- I considered information provided by the complainant and the Council.

My assessment
- Miss X complained she is not receiving the right care due to the lack of support provided by Adult Social Care Services.
- Following a Care Act Assessment in 2024 Miss X requested a care plan review which took place in 2025. During this review it was recorded that Miss X’s concerns were discussed, and she advised she was happy with the support she was receiving.
- Miss X was signposted to other services for concerns which fell out of the remit of Adult Social Care.
- During the complaints process, the Council advised Mss X that she could request another review if she felt that her support hours needed to be increased.
- Based on the information, it is unlikely we would find fault in the Council’s care plan review.
Final decision
- We will not investigate Miss X’s complaint because it is unlikely we would find fault.
