    Summary: On behalf of Company J, Mr X complained about how the Council assessed Company J’s application for use of sports facilities. We have found the Council at fault because it did not properly assess Company J’s application, and for failures in complaint handling. This caused uncertainty for Mr X and Company J. We have also found the Council at fault for failing to contemporaneously document how it assigned resources for successful applicants. The Council has agreed to apologise to Mr X and Company J. The Council has also agreed to improve its procedures to prevent these faults occurring in future.

    Summary: Mr X complained about the Council’s handling of his son’s Education, Health and Care plan and education in school between September 2022 and after September 2023 when he became of compulsory school age. We found the Council was at fault for the delay in deciding if A received all provision from section F of his Plan since April 2023. This caused Mr X distress and uncertainty. The Council agreed to apologise and pay Mr X a financial remedy.

    Summary: Miss Y complained that delays in the Education, Health and Care (EHC) assessment and planning process meant that her son did not receive the education he was entitled to. The delays were, in part, caused by a shortage of Educational Psychologists. The Council has agreed to pay £400 to Miss Y in recognition of the delay and a further £900 for D’s benefit. The Council will also arrange the proposed catch-up provision and explain the steps it is taking to improve the timeliness of EHC needs assessments.

Ms M complained the organisations failed to ensure her child, S, received therapy provision set out in his Education, Health and Care (EHC) Plan. She also complained about the Council’s and Trust’s complaint handling. We have upheld parts of Ms M’s complaint relating to therapy provision and complaint handling. The organisations have accepted our recommendations. We have now completed our investigation.

    Summary: Mrs X complained the Council failed to collect and/or return her garden bin on several occasions. While we find no fault in how the Council handled the missed bin collections, we do find fault in the way it managed her contact. However, this did not result in a significant injustice. We also find fault in the Council’s delay responding to her complaint, which caused her avoidable distress. We recommend the Council reviews the decision to restrict her contact.
