Summary: Ms X complains the Council did not provide suitable alternative provision for her child and delayed issuing the Education Health and Care Plan. Ms X says this caused her child to miss out on education and impacted their emotional wellbeing. We find no fault with the Council’s alternative provision offer. We do find the Council at fault regarding the delay in issuing the Education Health and Care Plan which caused injustice. The Council has agreed to make a payment to Ms X.

Summary: Mrs X complained about the Council’s actions during the Education, Health and Care needs assessment process for her child. We find the Council at fault for delay, poor communication, and failure to secure suitable full-time education. This caused a loss of special educational provision and missed education for her child, and avoidable distress, uncertainty, and time and trouble for Mrs X. The Council has agreed to apologise and make a payment to Mrs X.

Summary: We found fault by the Council on Mrs Y’s complaint about its failure to process her request for an Education, Health and Care plan within statutory timescales. It missed the statutory time limit by 39 weeks. It failed to consider whether it was appropriate to fund her daughter’s special needs it was aware of when she started home education. It also failed to consider its section 19 duties sooner, advise her and consider education other than at school sooner, or give her information about the consequences of home educating her. The Council agreed to send a written apology, pay £397.06 for the injustice caused by its failures, provide an Action Plan showing how future assessments will be completed within statutory timescales, and will ensure relevant officers consider section 19 duties and education other than at school during assessments where children are out of school. It will ensure it gives parents relevant information and improve communication with them.

Summary: Mrs X complained the Council failed to put in place education for her daughter when she could no longer attend her allocated school and failed to ensure her daughter received the provision in her EHC Plan. There is no fault in how the Council dealt with the education available to Mrs X’s daughter. There is evidence of some of Mrs X’s daughter’s provision not being in place. That meant her daughter missed out on some provision. The apology already offered to Mrs X is satisfactory remedy.
