Summary: We will not investigate this complaint about the Council taking recovery action against Ms X over unpaid council tax due from 2014 to the present year. We cannot consider these matters which have been subject to court proceedings. It was reasonable for Ms X to have challenged the liability to the Valuation Tribunal or in the magistrates court when the liability orders were sought. We will not consider the matters from before the last 12 months because it was reasonable for Ms X to complain to us sooner.

Summary: The Council caused Mr X frustration and distress when it incorrectly assessed that he was not eligible for housing support due to his immigration status. In recognition of the injustice caused the Council has agreed to pay Mr X £200 and demonstrate that it has taken action to improve its services. We do not find that the Council’s actions caused Mr X to miss out on interim accommodation or that the Council failed to have due regard to its duties under the Equality Act.

Summary: Ms X complained the Council has not provided support to her child who was out of school and has not agreed a school placement. We cannot investigate Ms X concerns that her child has not got a school placement or whether they received the specialist provision in their Education, Health and Care Plan as Ms X appealed to a Tribunal. We have not found the Council at fault for failing to provide Ms X’s child with education.

Summary: Mr X complained the Council failed to comply with the statutory timeframe for issuing an Education, Health and Care Plan. He also complained the Council failed to communicate effectively throughout the process. Mr X said the delays will have a negative impact in his child’s educational outcomes. We have found fault with the Council for the delay in issuing a final Education, Health and Care Plan and delays in the complaints process. The Council has agreed to apologise, make a symbolic payment and complete service improvements.

Summary: Mrs X complained about the Council repeatedly missing her assisted bin collection and about the conduct of refuse workers which caused her distress. We find the Council at fault which caused injustice. The Council has agreed to make a payment for the avoidable and unnecessary frustration caused to Mrs X.

Summary: Mr B complained on behalf of Mr C, about failings in respect of his social care needs and housing situation. Mr C has been without care since January 2021 and his sister, Ms D has been his main carer. We found fault in the actions of the Council. It has agreed to apologise to Mr C and Ms D, make a symbolic payment to each of them, arrange a care act review and a housing meeting review and improve its procedures for the future.
