Summary: Mr X complained the Council wrongly decided he and his family were not eligible for medical priority and emergency status on the housing register. He said this caused his family to be in overcrowded accommodation which impacts on his family’s health and development. While we do not find the Council at fault for its decisions, we find fault for a delay completing an assessment. This caused injustice. The Council has agreed to apologise and make a payment to Mr X to remedy the injustice caused.

Summary: Miss Y complained about the Council’s handling of her homelessness and housing applications, specifically its processing of her change in circumstances. We have found fault by the Council, causing injustice, in: its delays and communication failures processing Miss Y’s change in circumstances; failing to respond properly to her request for a suitability review; failing to move her to suitable temporary accommodation; failing to make proper efforts to fulfil its duties and have an agreed transparent policy for operating its transfer list. The Council has agreed to remedy the injustice caused by: apologising to Miss Y; making payments to reflect distress, uncertainty and the impact of living in unsuitable accommodation; and service improvements.

Summary: Yhere was fault in the way the Council investigated a safeguarding concern relating to the provision of care by a care home. As a consequence, Mr and Mrs D will always have the uncertainty that the outcome of the enquiry could have been different if the fault had not occurred. The Council has agreed to apologise and to pay a small symbolic sum.

Summary: Mrs B says the Council wrongly excluded her son from a weekly club without considering his special educational needs and delayed considering her complaint. The Council failed to have in place a behavioural policy and risk assessment and allowed the situation to drift. The Council delayed responding to the complaint. An apology, payment to Mrs B, introduction of a behavioural policy and a process for recording a child’s special educational needs, alongside training, is satisfactory remedy.

The Council has agreed to our recommendations to address the injustice caused by fault.

Summary: Mr X complained about the way the Council dealt with Z’s Education, Health and Care Plan and education and special educational needs provision. We have found fault by the Council in: failing to make alternative provision for Z from January to March 2023; deliver Z’s SEN provision from January to July 2023; and complete the EHC Plan review process within the statutory timescales. This fault caused injustice. The Council has agreed to remedy this by: apologising; making payments to reflect the distress and worry caused and the impact on Z of the missed provision; issuing the final amended EHC Plan; and making a service improvement.

Summary: Ms X complains that the Council wrongly passed her Council Tax account to enforcement agents to collect. The Council is at fault as it did not send Council Tax bills and correspondence to Ms X’s forwarding address. The fault caused significant distress to Ms X. The Council has agreed to remedy the injustice to Ms X by making a payment of £200 to her.

Summary: Ms F complained her child did not receive a full-time education for two academic years. We partially upheld the complaint, finding the Council did not respond properly when learning of the child’s absences from school in September 2022. As a result there was some loss of education provision and distress caused to Ms F. The Council has accepted this finding and agreed action, set out at the end of this statement, to remedy that injustice and improve its service.
