Summary: Ms X complained the Council did not provide suitable education to her child when they were out of school and delayed updating their education, health and care plan. Based on current evidence I intend to find the Council at fault for not providing suitable education and delaying making a decision on Ms X’s child’s annual review. Ms X’s child has missed a significant amount of education. To remedy the injustice caused the Council agreed to apologise, make a payment to recognise loss of education and secure suitable provision for the child.

Summary: Mr X complained that the Council wrongly decided his father, Mr Y, deprived himself of assets for the purpose of reducing his care fees. We found that the Council’s decision was not supported by all the available evidence, and so was fault. That fault caused Mr X and his siblings an injustice for which we have recommended a remedy.

Summary: Mr X complained it took the Council too long to give him a decision on his homelessness application and did not respond to his concerns about the suitability of the accommodation it provided him with. Mr X said he has lived in a property which he believed was unsuitable. We found the Council at fault for the time it took to give him a decision on his homelessness application and look at the suitability of his accommodation. The Council agreed to apologise to Mr X, make a payment to him and carry out a service improvement.

Summary: We will not investigate this complaint about the Council’s decision to remove a brick wall near the complainant’s home and erect a temporary metal fence. The Council confirmed the wall was removed because it was unsafe and dangerous. It confirms it is reconsidering whether a brick wall can be rebuilt. It also offered the complainant £150 in recognition of delay in its responses to her complaint. We consider further investigation will not lead to a different outcome.
