  • Basildon Borough Council (24 014 753)

Statement Closed after initial enquiries Other 04-Feb-2025

Summary: We will not investigate this complaint about pest control on land close to Mr X’s property. This is because there is no evidence to suggest fault by the Council and because past events fall outside our jurisdiction due to the passage of time.

  • Lincoln City Council (24 014 829)

Statement Closed after initial enquiries Other 04-Feb-2025

Summary: We will not investigate this complaint about the Council refusing to use its powers on illegal eviction. The complaint is late without good enough reason to investigate it now. The complaint also concerns interpretation of the law, on which it is reasonable to expect Mr X to take court action.

  • Kingston Upon Hull City Council (24 014 838)

    Statement Upheld Enforcement 04-Feb-2025

Summary: We will not investigate this complaint about the actions of the Council on planning and enforcement matters. Mr X had a right to appeal against refusals of planning permissions or any enforcement notices. Also, Mr X wants the enforcement officer prosecuted, an apology and retraining. The Council has apologised for failing to follow the enforcement process correctly. It has arranged for further training for the officer. We cannot require the Council to prosecute its employee. We consider that further investigation will not lead to a different outcome.

  • North Northamptonshire Council (24 014 934)

Statement Upheld Special educational needs 04-Feb-2025

Summary: The Council failed to adhere to the timescales agreed with the Ombudsman over completing a service improvement recommendation from a previous case; this was fault. The Council agreed to complete a review of why these delays occurred and to advise what it intends to do to prevent a reoccurrence.

  • Cornwall Council (24 012 941)

Statement Upheld Special educational needs 04-Feb-2025

Summary: We upheld Mrs X’s complaint about delays in the Education, Health and Care process regarding her child, Y, and about the Council’s poor communication. The Council agreed to resolve the complaint early by apologising and paying Mrs X a total symbolic payment of £900 to acknowledge the injustice caused.

  • Dorset Council (24 013 073)

Statement Closed after initial enquiries Special educational needs 04-Feb-2025

Summary: We will not investigate this complaint about alleged failures to meet Miss X’s child’s special educational needs. The complaint principally concerns the alleged actions of an academy school in issuing informal exclusions, which we cannot investigate. There is not enough evidence of fault by the Council in meeting its duties to offer alternative educational provision and to assess the child’s special educational needs to warrant investigation by us.

  • Fareham Borough Council (24 013 187)

Statement Closed after initial enquiries Other 04-Feb-2025

Summary: We will not investigate Mr X’s complaint the Council ignored his service requests after it decided he was a vexatious complainant. There is not enough evidence of fault to justify our involvement.

  • Medway Council (24 014 318)

Statement Closed after initial enquiries Charging 04-Feb-2025

Summary: We will not investigate Mrs X’s complaint about the domiciliary care provided to her late father Mr Y by the care firm commissioned by the Council. There is insufficient significant injustice to Mrs X to warrant an investigation.

  • Birmingham City Council (24 014 439)

Statement Closed after initial enquiries Other 04-Feb-2025

Summary: We cannot investigate Mr X’s complaint that a neighbour blocked a private right of way to his property with a fence. This is because the primary issue is about a potential breach of a contract, which only a court can determine.

  • London Borough of Lambeth (24 014 477)

Statement Closed after initial enquiries Traffic management 04-Feb-2025

Summary: We will not investigate this complaint about a Low Traffic Neighbourhood scheme implemented by the Council, and associated penalty charge notices received by the complainant. There is insufficient evidence of fault by the Council, and it is reasonable to expect the complainant to have use the alternative remedies which were available.
