We find fault with the Council for delay, failing to provide specialist provision as outlined in the Plan, and lack of communication. We have suggested a symbolic payment for the frustration and distress caused as a result.

    Summary: When Ms X was homeless the Council housed her in unsuitable bed and breakfast accommodation, failed to properly investigate her reports of a rodent infestation and significantly delayed accepting housing duties to her. There was no fault in how the Council considered her priority points on its housing register or her location requirements for long-term housing. The Council has recently taken relevant action to improve its services. However to recognise the personal injustice caused to Ms X, the Council has also agreed to apologise and pay Ms X £1,500.

    Summary: Mrs X complained that the Council did not deal with her son Y’s education properly. The Council is at fault because it did not consider providing s19 alternative education provision. Mrs X and Y suffered avoidable distress. Y suffered loss of educational provision. The Council should apologise, pay Mrs X and Y £200 each for distress, pay Mrs X £2,000 for missed educational provision and provide guidance to staff.

    Summary: We will not investigate Mr X’s complaint about the Council’s handling of his housing register application. This is because there is insufficient evidence of fault in the Council’s decision-making. The Council has apologised for its delay in making decisions, which is sufficient to remedy the injustice caused.

    Summary: Mrs X complained the Council failed to provide suitable transport to school for her child, Y. The Council was at fault for not recording how it considered Mrs X’s appeals, for poor communication and decision letters and for the way in which it provided a personal transport budget. This meant the family had to transport Y to school. The Council has now agreed to provide Y with suitable school transport. It has also agreed to apologise to Mrs X and make a payment to acknowledge the distress and frustration caused.

    Summary: Mrs X complained about a decision to close bus stops in the city centre and move bus services to start and terminate at a bus station. She said the changes are discriminatory and caused her hardship. The Council was not the decision maker on bus route changes. It was therefore not at fault for any impact the changes may have had on Mrs X or other bus users.

    Summary: Miss X complained about the Council’s decision to stop her Housing Benefit and failure to notify her of this. Miss X said this left her with a debt of rent arrears. We find the Council at fault for not properly notifying Miss X of its decision. The Council has agreed to apologise to Miss X and make a payment to recognise the injustice caused.

    Summary: Mr X complained about how the Council decided to approve a planning application for a temporary installation near to his home. Mr X said this has caused increased traffic and illegal parking in the area. We do not find the Council at fault.

    Summary: We will not investigate Mr X’s complaint about the Council creating a safety plan for his ex-partner without any discussion with the county council or other agencies. This is because the fault did not cause any significant personal injustice.
