Forest of Dean District Council (24 007 337)
Statement Closed after initial enquiries Enforcement 16-Oct-2024
Summary: We will not investigate this complaint about damage to property. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. It is reasonable for the complainant to make a claim to the Council’s insurers in the first instance and then pursue his claim through the courts if necessary. Only the courts can determine liability.
-
North Northamptonshire Council (24 007 530)
Statement Closed after initial enquiries Allocations 16-Oct-2024
Summary: We will not investigate this complaint about the Council’s assessment of a housing application. There is insufficient evidence of fault which would warrant an investigation.
-
Central Bedfordshire Council (24 007 633)
Statement Upheld Other 16-Oct-2024
Summary: We will not investigate this complaint about the way the Council has dealt with the complainant’s enquiries about an insurance claim. The Council has recognised the initial responses to Mr X’s concerns fell short of its expected standards and has apologised. We consider that further investigation on this point will not lead to a different outcome. Also, Mr X can approach the Information Commissioner’s Office with his concerns about access to information. Finally, the Ombudsman cannot determine liability for damages. So we consider it reasonable for Mr X to contact the relevant insurer about damages to his car and if that fails to pursue the claim in court.
-
London Borough of Southwark (24 007 692)
Statement Closed after initial enquiries Parking and other penalties 16-Oct-2024
Summary: We will not investigate this complaint about unpaid Penalty Charge Notices (PCN) because there is not enough evidence of fault in the Council’s or its enforcement agents’ actions to warrant investigation.
-
Sunderland City Council (24 008 565)
Statement Upheld Assessment and care plan 16-Oct-2024
Summary: The Ombudsmen will not investigate this complaint about an avoidably delayed hospital discharge. The Trust and the Council have already accepted there were failings and apologised for them. It is unlikely that an investigation would be able to find evidence of an unremedied injustice.
