Statement Upheld Child protection 02-Jan-2025
Summary: Mr and Mrs X complained the Council failed to provide appropriate family support for the needs of their daughter. Mr and Mrs X considered there were missed opportunities to support both them and their daughter leading to their decision to ask for their daughter to be taken into foster care. We have found fault in the late provision of information ahead of a Child Protection Conference and failure to complete a carers assessment but consider the agreed action of an apology and procedural review provides a suitable remedy.

London Borough of Enfield (24 004 238)
Statement Upheld Residential care 02-Jan-2025
Summary: We upheld a complaint that Mr F received poor care while in a care home placement arranged by the Council. We also found the Council at fault for a flawed safeguarding investigation which followed. These faults caused injustice to Mr F who experienced a loss of a service and to his daughter who made the complaint, as distress. The Council has accepted these findings. At the end of this statement, we set out the action it has agreed to remedy this injustice and improve its service.

-
Kent County Council (24 004 875)
Statement Upheld Other 02-Jan-2025
Summary: Mrs B complained that the Council failed to provide adequate support to her and her son (C) when he was experiencing distress, failed to explain why he was not eligible for services from its disabled child team and delayed excessively in arranging personal assistant support through direct payments. We have found fault with the Council’s actions. The Council has agreed to apologise to Mrs B, pay her £1300 and provide evidence of improvements to its procedures for the future.
-
Gateshead Metropolitan Borough Council (24 002 763)
Statement Upheld Charging 02-Jan-2025
Summary: Mr X complained the Council wrongly invoiced home care visits for his wife which meant they incurred costs for care his wife did not receive and she suffered distress from not receiving the care she needed. We have found fault but consider the Council’s proposed actions of an apology, cancellation of care fees and a symbolic payment for inconvenience and upset provides a suitable remedy.
-
London Borough of Southwark (24 000 264)
Statement Upheld Allocations 02-Jan-2025
Summary: Miss X complained about the Council’s decision that she was not entitled to additional priority on its housing register. We found the Council to be at fault because it could not demonstrate how it made its decision. To remedy the injustice caused by this fault, the Council has agreed to apologise and make a payment to Miss X. It should also review her application and take action to improve its service in future.
-
Barnsley Metropolitan Borough Council (24 001 462)
Statement Not upheld Child protection 02-Jan-2025
Summary: We have discontinued our investigation into Miss X’s complaint about how the Council acted to protect her daughter. The Council has already accepted failings in all significant parts of
Miss X’s complaint, and it has offered suitable remedies for her injustice. It is unlikely that further investigation of the same issue would lead to a different outcome for Miss X.
