    Statement Upheld Homelessness 12-Feb-2025

Summary: Mr X complained the Council failed to properly administer a homelessness application and failed to issue a personalised housing plan. Mr X also said the Council provided unsuitable interim accommodation, delayed accepting a housing duty, and communicated poorly. We have found the Council at fault for these matters. The Council has agreed to apologise, pay a financial remedy, provide a right of review for the suitability of Mr X’s property, and carry out officer training. We have not found the Council at fault for failing to protect the household’s belongings.

Summary: There was a long delay in reviewing the care package for Mr X which essentially left Mr and Mrs A to manage the care themselves. Subsequently there was a significant delay in resolving the Direct Payments budget for Mr X which caused considerable anxiety to his parents, Mr and Mrs A. The Council has agreed to apologise, offer a sum in acknowledgement of the distress caused by its failings, and take action to resolve the outstanding issues.

  • Wigan Metropolitan Borough Council (24 004 315)

Statement Upheld Special educational needs 12-Feb-2025

Summary: Mrs X complained the Council delayed amending her son, Y’s, Education, Health and Care (EHC) Plan following an annual review by over a year. The Council was at fault. It delayed issuing Y’s amended EHC Plan which meant he lost out on some of the specialist educational provision in his Plan between September 2023 and July 2024. This also caused Mrs X distress and uncertainty. The Council agreed to make payments to Mrs X to recognise the injustice caused and provide us with updates on the service improvements it has already carried out in response to this complaint.

  • Birmingham City Council (24 007 340)

Statement Upheld Refuse and recycling 12-Feb-2025

Summary: Mr X complained the Council has repeatedly failed to collect the household waste from his street. Mr X says they had no collections at all for three months between May and late August 2024 and that since then although some collections have been made, the waste is still not routinely collected as scheduled. We found the Council’s repeated failure to collect the household waste and recycling from Mr X’s street is fault. This led to an accumulation of waste in the street that is unsightly and smells unpleasant. The Council has agreed to apologise, make a payment to Mr X and monitor his collections.
