  • Lancashire County Council (23 017 676)

Statement Closed after initial enquiries Land 26-Mar-2024

Summary: We will not investigate this complaint about the Council’s assessment of monies owed by the complainant in connection with his purchase of formally owned Council land. This is because Mr Z’s complaint refers to alleged negligence and points of law which are best resolved through the courts. We do not consider there is any exceptional reason why Mr Z cannot take the matters alleged to court.

  • North Yorkshire Council (23 006 228)

Statement Upheld Special educational needs 26-Mar-2024

Summary: Mrs Y complained about the way the Council dealt with her child’s Education, Health and Care Plan and special educational needs provision. We have found fault by the Council in failing to: make all the provision in the Plan; complete the annual review process within the statutory timescales; and complete the agreed action plan for resolving Mrs Y’s complaint. These faults caused injustice. The Council has agreed to remedy this by apologising to Mrs Y, making payments to recognise the impact of the missed provision and distress caused, taking steps to complete the review process and a service improvement.

  • London Borough of Lewisham (23 006 254)

    Statement Upheld Homelessness 26-Mar-2024

Summary: Ms X complained the Council failed to provide her and her children with suitable temporary accommodation. We found fault by the Council. This caused Ms X and her children a significant injustice because they were left in unsuitable accommodation for 10 months. The Council agreed to make Ms X a payment in recognition of the costs she incurred in taking her children to school and the impact of the difficulties the long journey caused them.

  • London Borough of Ealing (23 010 504)

Statement Closed after initial enquiries Allocations 26-Mar-2024

Summary: We will not investigate this complaint about the priority given to Miss X’s housing application. Any investigation is unlikely to find fault undermining the Council’s decision-making.

  • Manchester City Council (23 010 915)

    Statement Upheld Charging 26-Mar-2024

Summary: Ms A complains the Council did not properly advise Mrs X about care contributions her son Mr X had to pay when he moved into residential care. We found fault by the Council. It has agreed a suitable remedy.

  • Sheffield City Council (23 011 510)

    Statement Upheld Allocations 26-Mar-2024

Summary: X complained about the way the Council has dealt their and Y’s housing application. They complains the Council has wrongly reduced their priority and has bid on unsuitable properties it knew they would not accept. The failure to properly explain the outcome of the OT assessment, and to clearly identify the types of properties and areas that would be considered suitable for their needs is fault. This fault has caused X and Y an injustice.

  • MACC Care Limited (23 011 820)

    Statement Upheld Residential care 26-Mar-2024

Summary: Mrs Z complains about the standard of care provided to her mother at Wolfrun Rose Care Home and the delay in responding to a complaint about this. We will not pursue the complaint about the standard of care because Mrs Z’s mother has died and so a personal remedy cannot be provided. There was fault in the complaint handling and the action already taken by the care provider is considered appropriate.

  • Dudley Metropolitan Borough Council (23 012 282)

Statement Closed after initial enquiries Special educational needs 26-Mar-2024

Summary: We will not investigate this complaint about how the Council conducted the process of naming an educational setting in an Education Health and Care Plan for Mrs X’s child. This matter is not separable from the content of the Plan, which was subject to a right of appeal to a Tribunal it was reasonable to use. We are considering the matter of alternative educational provision in another complaint.

  • Leeds City Council (23 012 516)

    Statement Upheld Charging 26-Mar-2024

Summary: Mrs Y complained that services failed to provide funding for her father’s post-hospital care for long enough. We found that an Integrated Care Board funded the person’s care for an appropriate length of time. However, we found fault in the way the Council explained the process to the family. This caused avoidable stress, frustration and time and trouble for Mrs Y. In addition, we found fault in the way the Council responded to the family’s request for a meeting to discuss their complaint. We recommended that the Council apologises, makes a small financial payment to recognise the injustice and provides evidence of its learning from the complaint.
