    Summary: Mrs Y complains about the way the Council financially assessed her adult daughter, Miss W, who has care and support needs. She said the Council did not consider Miss W’s monthly outgoings. The Council made an error with its assessment of Miss W’s benefit entitlement but corrected this and apologised. There is no other fault in the financial assessment. The Council also delayed in acknowledging Mrs Y’s complaint but has apologised for this which is an appropriate remedy.

This caused unnecessary time, trouble, inconvenience and distress. The Council will apologise, make a symbolic payment and service improvements.

    Summary: There was fault by the Council, because it did not contact the complainant to discuss whether she would find bed and breakfast accommodation suitable as interim accommodation, told her she needed to submit documents before it could book interim accommodation for her, and did not respond helpfully when she informed the Council she could not access her housing register account. The Council has agreed to offer the complainant a financial remedy and apologise to her for this, and also to issue guidance to its staff.

    Summary: Mrs X complained about the Council’s failure to deliver therapies included in her daughter’s (Y) Education Health and Care Plan, to agree a Personal budget for Y and to review Y’s plan. Mrs X also complained about the way the Council carried out Y’s Education Health and Care needs assessment. We found fault with the Council. This fault caused injustice to Y and Mrs X. The Council has offered a suitable financial remedy. The Council has also agreed to ensure Y receives therapies in the new school year and improve its Personal budget process.

It failed to involve Ms X or the family with Mrs Y’s care planning and failed to tell them about one of two falls. This was poor communication causing avoidable distress for which this Council will apologise.
