Summary: Miss X, on behalf of her son Mr Z, complained the Council failed to convene a meeting to identity a suitable care provider to deliver social care for her son. The Ombudsman recommended the meeting as part of a remedy on a previous complaint and the Council failed to arrange it which is fault causing further frustration and Mr Z missing out on provision. A payment to recognise the frustration is agreed.

This caused him distress and uncertainty and his sister, Miss X frustration and uncertainty. The Council has agreed to apologise, make payments and through training or guidance remind staff of the importance of post 25 transition planning.

Summary: Mr X complains on behalf of the late Mrs Z that the Council failed to keep adequate records regarding a fall from a hoist. Mr X says the Council delayed in advising of and completing a Deprivation of Liberty Safeguards assessment and failed to consider or record safeguarding concerns. Mr X also says the Council denied access to Mrs Z’s records. Mr X says this has caused the family significant distress. We have found fault in the Councils actions for delay in completing a Deprivation of Liberty Safeguards assessments and completing a safeguarding investigation. The Council has agreed to issue Mr X with an apology.

Summary: Ms Y complains about the Council’s failure to safeguard a vulnerable adult before their death. We have discontinued our investigation because the matters complained about are currently subject to a serious incident safeguarding review, criminal investigation and Coroner’s inquest.

Summary: We cannot investigate this complaint that the Council has failed to make educational provision for the complainant’s daughter and failed to properly identify and address her special educational needs. The complainant has used her right to appeal to the First-tier Tribunal (Special Educational Needs and Disability) and the Courts have decided that the Ombudsman cannot intervene where the right to appeal has been used. We will not investigate part of this complaint as it is late and there are no good reasons to investigate now.
