Statement Closed after initial enquiries Noise 29-Mar-2023

Summary: We will not investigate this complaint about the Council’s response to concerns Mr X raised about an event held in a park whose noise affected elderly residents in a nearby home. This is because we are unlikely to find evidence of fault by the Council sufficient to warrant an investigation and any dissatisfaction Mr X may have with the Council’s response to his FOI request is best directed to the Information Commissioner’s Office.

  • Reigate & Banstead Borough Council (22 008 344)

Statement Closed after initial enquiries Noise 28-Feb-2023

Summary: We will not investigate this complaint about the Council’s investigation of a report of a noise nuisance. The complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. The complainant became aware of the noise concerns nine years ago. The complaint is therefore late, and we have seen no reason why the complainant could not have contacted us much sooner.

  • North East Derbyshire District Council (22 003 195)

    Statement Upheld Noise 24-Feb-2023

Summary: The Council took too long to establish the planning position and resolve the unauthorised use of land next to Mr B’s home. Mr B suffered noise disturbance that will be mitigated by a barrier required by the planning permission the Council later approved. The Council’s avoidable delay however meant that Mr B suffered noise disturbance for longer than necessary. The Council has agreed to remedy this.

  • Exeter City Council (22 004 986)

Summary: There was no fault by the Council. It considered properly whether it should take further enforcement action to compel the complainants’ upstairs neighbour to complete sound insulation work.

  • South Kesteven District Council (22 014 890)

Statement Closed after initial enquiries Noise 24-Feb-2023

Summary: We will not investigate this complaint about the Council’s investigation of Miss X’s complaint about noise from neighbouring premises. There is insufficient evidence of fault which would warrant an investigation.

  • West Northamptonshire Council (22 014 619)

Statement Closed after initial enquiries Noise 22-Feb-2023

Summary: We will not investigate this complaint about the Council’s refusal to deal with reports of noise from the complainant’s neighbour. We have not seen evidence of fault which justifies an investigation and further investigation is unlikely to lead to a different outcome. Also, it is reasonable to expect the complainant to contact the Information Commissioner’s Office if he believes the Council has failed to provide him with information he is seeking.
