    Summary: Mrs B complained the Council failed to provide education to meet her son’s needs as specified in his Education, Health and Care Plan (EHCP). She said that as a result her son missed education. There was fault in the delay by the Council which caused injustice to Mrs B and her son. The Council agreed to apologise and to make a payment.

The Ombudsman finds the Council at fault. The delays meant B missed out on certain educational provision. Mrs X incurred costs connected with the time and trouble she was put to chasing the Council. To remedy the injustice caused to Mrs X and B, the Council has agreed to apologise to them, and make a payment to reflect the injustice caused to Mrs X and B by the fault.

    Summary: Mrs X complains that the Council failed to ensure therapies and assessments detailed in her son, D’s, Education, Health and Care Plan were provided. The Ombudsman finds there was avoidable delay, missed provision for D and time and trouble caused to Mrs X in chasing this up. We have made recommendations for an apology, financial remedy and service improvements.

She also complained the Council failed to respond to her complaints about the matter. We find the Council was at fault by not providing Ms E with a realistic timescale of when it would complete the agreed points to resolve her complaint. The Council has agreed to apologise to Ms E for the injustice caused to her.

    Summary: Mrs C complained about delay by the Council in issuing her son’s Education Health Care Plan following a review and reassessment. Mrs C also says that the Council has failed to acknowledge that she was forced into Elective Home Education. We find the Council failed to, complete an annual review of the Plan in 2018, inform Mrs C of its reassessment decision in a timely manner and there was a significant delay in issuing a final Plan. We recommend an apology and financial payment for the injustice caused. We have found no further fault by the Council.

    Summary: The complainant says that the Council delayed in completing her granddaughter’s Education, Health and Care Plan and this has meant the child has lost out on important provision and the family caused avoidable distress. The Ombudsman upholds the complaint and has recommended actions to remedy the resulting injustice. The Council has accepted these. Therefore, the Ombudsman has completed his investigation and is closing the complaint.
