    Summary: the Council delayed issuing a decision that it would not amend Mr F’s Education, Health and Care Plan following an annual review meeting in March 2019. This amounts to fault that caused injustice in the form of frustration and avoidable time and trouble. The Council has already apologised for this but will now make a payment of £100 to further recognise the injustice this caused. There is no fault in regard to provision made under the Plan. The other parts of the complaint are out of jurisdiction as Mr F’s mother appealed to the Special Educational Needs and Disability Tribunal about them on his behalf.

    Summary: Mr X complained the Council failed to arrange a proper assessment of his daughter’s needs and then refused to refund the costs of the assessment when he commissioned it. I have discontinued my investigation because the Ombudsman cannot investigate this complaint. This is because the matter is inextricably linked to the matters considered by the Special Educational Needs and Disability Tribunal and is, therefore, outside our jurisdiction.

    Summary: Mr and Mrs E complained about the Council’s delays in dealing with their son’s Education, Health and Care plan. They also complained about the Council’s communication with them. We find the Council delayed dealing with Mr and Mrs E’s son’s Education, Health and Care plan and delayed providing him with alternative and specialist provision. The Council also failed to update Mr and Mrs E and delayed responding to their correspondence. The Council has agreed to our recommendations to address the injustice caused.

    Summary: Mrs B’s child has an Education, Health and Care plan. She complained the Council failed to take appropriate action in respect of her child’s education when they were unable to attend school for health reasons. We find there was fault by the Council in the EHC plan process. The faults identified led to injustice, for which an apology and financial remedy have been agreed.

    Summary: the Council took too long to issue G’s Education, Health and Care (EHC) Plan. It failed to ensure the support required by her plan was provided. The Council failed to assess G’s needs and consider alternative education when G was unable to attend school due to anxiety. The Council relied on G’s schools when it should have made alternative arrangements itself. It took too long to reassess her needs and amend her plan following her autism diagnosis in April 2019. The Council was unable to provide a special school place until September 2020. As a result, there has been considerable disruption to G’s education over a period of at least two years. There has been a lack of joined-up approach from the Council, and Mr and Mrs X have been left to deal with an incredibly complicated situation themselves.

    Summary: Ms V complained the Council failed to meet her son, W’s, needs when he was out of school and failed to consider her needs over the time she had to support him. She said this had caused her time, trouble and distress and that W had missed out on education that he should have received. We have found evidence of fault leading to injustice and the Council has been asked to make an apology, pay a financial remedy and consider its procedures going forward.

    Summary: Mr D complained the Council delayed issuing an Education, Health and Care plan for his son and it failed to provide the provision set out in the plan. As a result, Mr D said his son was educationally disadvantaged and experienced distress. He said he also experienced distress, time and trouble in providing some of the support himself. The Council was at fault for the delay in completing the plan and for failing to provide some of the provision set out in the plan. It agreed to make a payment to acknowledge the loss of special educational needs provision for his son. It also agreed to review its procedures and ensure its staff are aware of its special educational needs’ responsibilities.
