    Summary: Mr F’s son, B, suffers from anxiety. Mr F complained the Council did not provide education for B when he was unable to attend school due to illness. B missed education because of a flaw in the service designed by the Council to fulfil its duties to children unable to attend school. The Council “outsourced” its responsibilities to schools and did not retain sufficient oversight and control. This meant the Council was either unaware or not in a position to act when things went wrong.  The Council relied on B’s school to make decisions about B’s education. When attempts to secure B’s return to school failed, the Council should have arranged suitable education for him. The service designed by the Council failed. B was without education for four months as a result.

    Summary: Mrs X complains the Council failed to provide appropriate advice regarding her options when she withdrew her son from school due to his ill health. She complains a council officer suggested she had acted illegally could be prosecuted if her son did not receive an appropriate full-time education. The Council’s failure to provide full information or to direct Mrs X to the Council’s other education teams for advice on her options amounts to fault. This fault has caused Mrs X and Y an injustice.

    Summary: Ms F complains the Council failed to make alternative educational provision for her son. We have found fault that has caused her son to lose out on education and the family significant distress. The Council has agreed to apologise, make a payment for her son’s educational benefit and review its commissioning arrangements for alternative provision.

    Summary: Ms X complained about the way the Council dealt with her daughter’s Education Health and Care Plan. We found fault because the Council delayed in issuing the final Plan. The Council was also at fault in the way it dealt with the statutory Stage 2 investigation into Ms X’s complaints as it failed to issue an apology as agreed with the recommendations in 2018. The Council has agreed to apologise to Ms X and her daughter so we have completed our investigation.

    Summary: The complainant says that the Council failed to provide alternative education to her son who was unable to attend his primary school because of ill health. The Council also delayed in completing the son’s Education, Health and Care Plan. The Ombudsman finds fault causing injustice on both complaints. He has recommended actions to remedy the injustice and to improve future practice. The Council has agreed to these and therefore we have completed our investigation and are closing the complaint.

    Summary: Mr X complained after the Council stopped providing alternative education for his daughter, D at home. He said D was not well enough to return to school for alternative provision and the Council’s decision left him with no choice but to electively home educate. The Council was at fault in how it ended D’s home tuition, however that fault did not cause D an injustice.

    Summary: Mrs X complained the Council failed to arrange suitable alternative education for her son, Y, after he stopped attending school due to ill health. She also complained the Council allocated insufficient funding towards Y’s education. Mrs X said this situation caused her stress and negatively affected Y’s educational and social development. The Council was at fault when it delayed arranging alternative education for Y and failed to issue a final EHC Plan within statutory timescales. However, this did not cause Y an injustice.

    Summary: The Ombudsman will not investigate Mr X’s complaint about a data breach. The Office of the Information Commissioner is better placed to deal with the breach and Mr X has a right to take court action it would be reasonable for him to use.

    Summary: there is no evidence of fault in Manchester City Council’s handling of its concerns about the suitability of the home education Ms D was providing to her daughter. As there is no evidence to corroborate Ms D’s account of the actions of a Council officer in July 2019 and it contradicts the officer’s record, this complaint is not upheld.

    Summary: Mrs X complained the Council had failed to provide a suitable full-time education to her child, Y, who could not attend school because of anxiety and other health problems. As a result, Mrs X said Y has been disadvantaged educationally. The Council was at fault for not ensuring a suitable education for Y from October 2019 to February 2020. It should make a payment to acknowledge the loss of education for Y. It should also review its policies to ensure suitable education is in place for those who are unable to attend school or are unable to provide the required specialist medical evidence.
