    Summary: The Ombudsman cannot investigate Mr Q’s complaint about the Council’s refusal to do repairs to his council property or its refusal to give him an allocated parking space. This is because we have no jurisdiction to investigate the housing management issues complained of.

    Summary: Mr Y complains on behalf of his tenant, Mr X about the way the Council handled the Disabled Facilities Grant process which funded adaptations to his home. Mr Y says the work was completed to a poor standard. The Council accepts the contractor did not complete the work to a satisfactory standard. The Ombudsman has found fault in the process followed by the Council and delay responding to Mr X’s complaint and agreeing the remedial work. To remedy the injustice the Council should make a payment to Mr X and Mr Y, agree a way forward to carry out remedial work within specified timescales and put in place an action plan to address the issues raised in this complaint.

    Summary: There was no fault in the Council’s handling of an application for a Disabled Facilities Grant. A different council had previously given provisional approval to the grant, but the Council then concluded the complainant was not financially eligible, and there is no fault in its decision. There was a significant delay in the Council’s response to the complaint, however, for which it has agreed to apologise. The Council has also agreed to ensure its home improvement agency’s complaints procedure is explained on its website.

    Summary: Mrs X complains about how the Council replaced her broken stairlift. Mrs X says issues in replacing the lift caused her significant distress and harmed her health. The Council is at fault, including for delays in fitting the stairlift and meeting Mrs X’s needs. The Council has agreed to apologise, make a payment to Mrs X and remind staff of the procedure for Disabled Facilities Grants.

    Summary: Ms B complains the Council’s home improvement agency and contractors failed to properly to carry out Disabled Facilities Grant works at her home. The Ombudsman found fault with the Council causing injustice. The Council failed to quality assure the work on Ms B’s bathroom before deciding it was complete and paying the contractor’s final invoice. The Council was also at fault for its delay in resolving the matter. The Council has agreed to remedy this injustice.

    Summary: There was a delay of about two months in arranging Mr D’s direct payment. This was fault by Kent County Council which has a legal duty to meet a person’s eligible care needs. It meant Mr D lacked support with personal care to enable him to wash. The Council will apologise and pay him £250 to reflect a loss of service to which he had a legal entitlement.

    Summary: Mrs X complained about the Council’s handling of her application for disabled adaptations. In particular, she says the Council agreed to a downstairs extension then changed its mind. The Council was at fault for telling Mrs X the extension was approved before completing its assessment. It has already apologised for this. There was no fault in the way it reached a later decision to approve a through floor lift and ground floor toilet.

    Summary: Mr C complained about the way in which the Council dealt with his request for adaptations and his subsequent complaint. The Ombudsman found fault with the way in which the Council communicated with Mr C. There was also an unreasonable delay in providing an OT assessment. The Council has agreed to apologise to Mr C, create a leaflet to provide clear information at the outset and develop an action plan to ensure clients receive an OT assessment in a timely manner.
