    Summary: The Ombudsman finds fault with the Council for reducing support for Mr X’s eligible care needs without discussing this with him, and for delaying reassessing his needs. This caused Mr X avoidable distress and uncertainty. The Ombudsman also finds fault with the Council for not assessing Mr X’s parents support needs, for not considering Mr X’s previous history in decision making, and for poor complaint handling. The Council has agreed to apologise to Mr X, and pay him and his parents in recognition of the distress and delay caused. The Council has also agreed to reinstate Mr X’s previous support until it can reassess his eligible care needs and assess his parents for support. The Council will also review its procedures for reviewing eligible care needs, recording information and how it communicates with service users where their case is being transferred.

    Summary: Miss X complains about the Council’s decision to reduce her care package. She also complains the Council contacted her doctor about her mental health without consent. We find fault with the Council for not completing a care assessment properly and for not meeting all of Miss X’s eligible needs. We also find fault with the Council for contacting Miss X’s doctor without consent, but this did not cause a significant injustice.

    Summary: We shall not pursue this complaint about the Council sharing information with another organisation. This is because it would be more appropriate for the Information Commissioner to consider this.

    Summary: Mr X complained about the Council’s failure to provide overnight care and related matters. This caused distress and affected his well-being. We have found some fault in how the Council considered his request for services. Mr X’s medical condition was not recorded correctly and the Council did not properly consider how his fluctuating needs could be met. To remedy the injustice caused, the Council has agreed to apologise and make a payment to Mr X, amend his assessment and review his care and support arrangements.

    Summary: There was an incident where a care agency failed to give Mrs C her medication. The Council addressed the problem appropriately by starting a safeguarding investigation and preventing any repeat of the problem. There was some fault in the Council’s assessment of Mr B’s needs as a carer and the Council has agreed to offer Mr B a further assessment.

    Summary: Mr R, complains the Council did not carry out an assessment of his care needs before his discharge from hospital. The Ombudsman upholds the complaint. Our view is the Council has made a suitable offer of a remedy.

    Summary: Mrs B complained the Council had not dealt properly with her father’s financial assessment and based demands for payment on levels of care Mr C did not received. Mrs B says this caused Mr C distress and financial difficulty. The Council was at fault for not having a charging policy document. This caused Mrs B and Mr C uncertainty. The Council has agreed to produce and publish a charging policy.

    Summary: Mrs D complains the Council failed to provide timely and appropriate support when her family sought an assessment for her late father and in response to their requests for emergency respite and night sitting services. Mrs D says her late father did not receive the support he needed and her mother took on the responsibility of main carer without adequate support. We have found fault by the Council but consider the agreed action of an apology and payment in addition to the actions it has already taken provides a suitable remedy.

    Summary: Mr B complained about how the occupational therapy service communicated with him. He said poor communication caused him inconvenience and distress resulting in carer breakdown, and it delayed his brother’s assessment. The Council accepted its communication was not best practice, apologised and issued staff guidance. The remedy offered by the Council was sufficient to remedy the injustice to Mr B and his family.

    Summary: Mr D complained about his adult son’s access to mental health aftercare which should be arranged and provided by the Council and the CCG. He also complained about an error in an NHS Trust’s medical records which was preventing his son receiving the services he was entitled to. We decided not to investigate Mr D’s complaint against the Council and the CCG as the issues have since been resolved. Mr D’s complaint against the NHS Trust can be considered separately by the Parliamentary and Health Service Ombudsman.
