    Summary: The Council was not at fault for the information it gave
    Mrs B about potential social care charges before she moved into a care home. It was also not at fault for discussing these charges with Mrs B without her daughter present, as she had capacity to make decisions about her own care. The Council was, however, at fault for a delay in completing Mrs B’s financial assessment. It has already apologised, so no further action is needed.

    Summary: The Council was at fault because it delayed completing Mr F’s assessment, care and support plan and in reassessing his disability related expenditure. It also failed to seek expert advice during the assessment. The fault caused a loss of service and avoidable distress. To remedy the injustice, the Council will apologise, make payments, seek specialist advice and review Mr F’s care and support plan following that advice.

    Summary: Mrs D complains about a lack of urgent interim care for her mother by a Council, Medvivo, and a GP Surgery. We found fault with the Council which caused distress to Mrs D and her family. The Council has agreed to compensate Mrs D for this.

    Summary: Mr B complained about the way in which the Council dealt with his request for adaptations and about the Council’s decision to stop his Direct Payments. We found there was an unreasonable delay in carrying out Mr B’s OT assessment, following a request from Mr B’s GP. This resulted in distress to Mr B for which the Council has agreed to apologise.

    Summary: Ms M complained about how the Council assessed her adult son, Mr S’s financial contribution towards his social care. She said it did not consider the £400 he contributed monthly to household costs. In addition, she said his mobility allowance was not sufficient to meet his transport costs to and from college. We find the Council was at fault for not considering his monthly contribution to the household in the financial assessment. It was not at fault in how it considered his transport costs. The Council has amended Mr S’s financial assessment. That remedies any injustice caused.

    Summary: There were delays on the part of the Council in providing the care and support plan, arriving at an appropriate level of support for Mr L’s respite and considering the eligibility of some needs for Disability-Related Expenditure (DRE). It was not fault by the Council to advise the family about employment matters in line with national guidance and its own policies. The Council has offered to discuss any exception to its policy with Mr X.

    Summary: Ms B complained the Council delayed assessing her father’s (Mr D) care needs, delayed assessing his mental capacity to decide where to live, and delayed making a decision in his best interests. We have upheld these complaints. This meant Mr D stayed at a care home longer than necessary and has a debt of over £15,000, for care fees which he cannot afford to pay because the Council failed to act in his best interests. The Council’s actions also had an impact on Ms B’s mother (Mrs D) at a time she was suffering carer crisis. The Care Provider has pursued her for the fees, including threatening bailiff action, which has been distressing.

    Summary: We have partially upheld Mr S’s complaint about his father’s discharge from hospital to a residential care home. The Council and Trust have already apologised to Mr S and we consider this a suitable remedy for distress caused to Mr S. The Council says it has already improved its way of working following Mr S’s complaint. We have asked for evidence of these improvements and recommended further service improvements. The Council and Trust accept our recommendations, so we have completed our investigation.

    Summary: Miss X complained the Council delayed in completing an assessment of her care needs. Miss X says she needed to use her disability benefits to pay for care because of this delay. Miss X also complained the Council has completed the financial assessment of her care needs incorrectly. Miss X says the Council incorrectly asked her to contribute towards her care costs. The Ombudsman found fault with the Council’s delay in assessing Miss X’s care needs. The Council has accepted a mistake was made with Miss X’s financial assessment. The Council agreed to the Ombudsman’s recommendation to backdate Miss X’s direct payments to June 2019 and correct Miss X’s financial assessment.
