    Summary: the complainant complained the Council failed to properly assess her mother’s care and support needs, or her finances leading to a lack of suitable care and creating a large debt. The Council said it assessed the care and provision needed. The Council said it correctly assessed the service user’s financial contribution, but this was not paid resulting in the debt now on the account. We find the Council acted without fault in assessing the care needs and financial contributions the complainant’s mother needed to pay.

    Summary: Mrs X complains that the Council did not properly assess the late Mrs Y’s needs or her mental capacity and did not ensure her needs were met. She also says it did not explain the funding for Mrs Y’s short term care home placement so she believed it would be funded by the NHS. Mrs X says Mrs Y had no money to contribute so the family is left to pay the outstanding charges. We found no fault in the Council’s actions.

    Summary: Ms X’s solicitor complained about issues regarding Ms X’s adult son, Mr Y, who has care needs because of his disabilities. We cannot and should not investigate the complaints about assessment of Mr Y’s care needs, care standards and safeguarding issues because of past and current Court of Protection proceedings. We will not investigate the complaint about funding as this is still being considered through the Council’s complaints procedure.

    Summary: Mrs Z has complained on behalf of her son, Mr Y. Mrs Z complains the Council has failed to provide Mr Y with a social worker for a prolonged period of time. She says this delayed his wish to move closer to his family. The Council was at fault for delays in providing Mr Y a social worker which in turned delayed his ability to move closer to his family. Also, the Council was at fault for failing to respond to Mrs Z in a reliable and responsible manner. This caused both Mr Y and Mrs Z and injustice and so the Ombudsman has recommended a remedy.

    Summary: Mrs X complains the Council has failed to deal properly with Mrs Y’s financial assessment (leaving her to fund her own care) and failed to consider whether she should be referred for a full assessment for NHS Continuing Healthcare. We have discontinued the investigation as the Council has withdrawn its financial assessment so it can reconsider its decision. Mrs Y’s family has now applied for NHS Continuing Healthcare.
