Statement Closed after initial enquiries Councillor conduct and standards 22-Nov-2019

Summary: Mr X complains the Council refuses to enforce its decision that a Councillor should apologise to him. The Ombudsman will not investigate this complaint. We have not seen any evidence of fault in the Council’s actions. Nor can we achieve the outcome Mr X is seeking.

  • North Somerset Council (19 009 628)

Statement Closed after initial enquiries Councillor conduct and standards 19-Nov-2019

Summary: The Ombudsman does not have grounds to investigate this complaint that the Council did not properly investigate a complaint that a Councillor had breached its Code of Conduct for Members. This is because there is no sign of fault by the Council which has caused an injustice to warrant our involvement.

  • Cornwall Council (19 009 809)

Statement Closed after initial enquiries Councillor conduct and standards 15-Nov-2019

Summary: The Ombudsman will not investigate this complaint about the Council failing to properly consider a code of conduct complaint against a councillor. This is because the complaint is late and there are no grounds to exercise discretion to consider it now.

  • London Borough of Tower Hamlets (19 003 446)

Statement Not upheld Councillor conduct and standards 12-Nov-2019

Summary: Mr X complained the Council failed to properly investigate his code of conduct complaints. The Council correctly followed its procedure to decide not to investigate his complaints in detail. It considered evidence from Mr X, the chairman of the committee and officers, consulted with the Independent Person and explained why it would not investigate further.

  • Mid Suffolk District Council (19 010 124)

Statement Closed after initial enquiries Councillor conduct and standards 06-Nov-2019

Summary: The Ombudsman will not investigate Mr B’s complaint about the actions of a parish council and a parish councillor or the about the Council’s failure to involve itself in his concerns about them. This is because parish councils and parish councillors fall outside our jurisdiction, there is no evidence of injustice caused to Mr B as a result of fault by the Council and we cannot achieve the outcome Mr B seeks for his complaint.

  • Rochford District Council (19 009 988)

Statement Closed after initial enquiries Councillor conduct and standards 30-Oct-2019

Summary: The Ombudsman cannot investigate Mr X’s complaint about a constitutional violation at a Council meeting. Mr X complains from his position as a councillor and so the complaint is outside the Ombudsman’s legal remit.

  • Cornwall Council (19 007 709)

Statement Closed after initial enquiries Councillor conduct and standards 29-Oct-2019

Summary: The Ombudsman will not investigate this complaint that the Council failed to properly consider a code of conduct complaint against a Cabinet Member. This is because the personal injustice arising from the alleged fault in the complaint process is not significant enough to justify the Ombudsman’s continued involvement.

  • East Riding of Yorkshire Council (19 007 925)

Statement Closed after initial enquiries Councillor conduct and standards 29-Oct-2019

Summary: The Ombudsman will not investigate Mrs B’s complaint about the Council’s decision to reject her complaint about her ward councillor. This is because there is insufficient evidence of fault in the way the Council reached its decision and the injustice Mrs B has suffered as a result of the Council’s decision on her complaint against the councillor is not of itself sufficient to justify our involvement.

  • Rochdale Metropolitan Borough Council (19 001 968)

Statement Closed after initial enquiries Councillor conduct and standards 22-Oct-2019

Summary: Mr X complained about the Council’s failure to report his allegations about a councillor’s interests to the police. The Ombudsman should not investigate this complaint. This is because it concerns allegations about an alleged criminal offence which is a matter for the police to decide. The Council did not consider there was evidence of a breach of the Localism Act 2011 to involve the police.

  • Birmingham City Council (19 007 986)

Statement Closed after initial enquiries Councillor conduct and standards 17-Oct-2019

Summary: The Ombudsman will not investigate Mr B’s complaint about the Council’s handling of matters relating to complaints made against a councillor. This is because complaints about past events from 2016 are late and so fall outside our jurisdiction and, with regard to more recent matters, an investigation by the Ombudsman is unlikely to lead to the outcome Mr B seeks.
