The Ombudsman cannot investigate the underlying noise nuisance actions which are outside jurisdiction because Mr X used his right of appeal to a court.

The substantive decision causing Mr X injustice was the Council’s refusal of planning permission, for which he had a right of appeal it would have been reasonable for him to use.
