    Summary: Mr B complains about the Council’s decision to increase the rent he pays for a commercial property he leases from it. The Ombudsman will not investigate the complaint because his lease contains an appeal mechanism to determine disputes about rent and an arbitrator so appointed will be better placed to consider this matter.

    Summary: Mr X complains the Council refuses to pay for damage to property caused by its tenants. The Ombudsman will not investigate this complaint. This is because Mr X has a right to take legal action if he considers the Council is liable for the cost to repair the damage.

    Summary: Mrs B complained on behalf of Company C, that the Council had incorrectly advised Company C in 2016 about removing damaged fencing around a games area, which it managed. Company C removed the fencing on the basis of the advice. The Council then issued a breach of condition notice requiring the fence to be replaced. This cost Company C over £10,000. We found fault with the initial advice the Council gave, but do not consider it caused Company C injustice as it was not reasonable for a specialist company to rely solely on that advice to remove the fence.

    Summary: Mrs X complained about the Council offering a loan for a lighting scheme which has left her school with a budget deficit when claimed energy savings were not realised. The Ombudsman cannot investigate this complaint. This is because the complaint is made on behalf of governors of a state school and it is not a body from which the Ombudsman can accept a complaint.

    Summary: The Ombudsman will not investigate Mr B’s complaint that the Council put improper influence on a third party. This is because we cannot safely establish the third party’s decision was a direct result of the information the Council provided.
