    Statement Not upheld Other 12-Dec-2019

Summary: the complainant says the Council failed to properly consider all material planning considerations when granting planning permission for a development near her home. This has caused noise and odour nuisance. The Council says it considered all material planning considerations including objections from the complainant and other residents when deciding to grant the application. The Ombudsman finds the Council acted without fault when deciding to grant the planning permission.

    Statement Upheld Other 10-Dec-2019

  • Somerset West and Taunton Council (19 011 489)

Statement Closed after initial enquiries Other 09-Dec-2019

Summary: The Ombudsman will not investigate Ms X’s complaint that the Council has failed to sweep a lane where she lives. There is not enough evidence of fault by the Council causing injustice to Ms X. And it would be reasonable for her to act through the courts if she wishes to enforce the Council’s highways duties.

Statement Closed after initial enquiries Other 09-Dec-2019

Further consideration of parts of the complaint is unlikely to find fault. And the courts are better placed to decide if the Council is liable to Mr D for the damage to his trailer.

  • Medway Council (19 002 480)

    Statement Upheld Other 29-Nov-2019

Summary: C complains the Council failed to investigate properly and take appropriate action in response to their reports of nuisance. C says they suffered from unacceptable levels of nuisance for longer than necessary which has exacerbated an existing health condition and created repeated pest problems. The Ombudsman finds fault in the way the Council dealt with some of C’s reports but considers the agreed actions of an apology, £200 with a review of the current situation and some procedural improvements are enough to provide a suitable remedy.
