  • Crawley Borough Council (19 015 390)

Statement Closed after initial enquiries Noise 25-Feb-2020

Summary: Mr X complained the Council did not take sufficient action to deal with noise from shops next to his home. He also complained the Council should have warned him about issues with noise before he moved into the property. We will not investigate this complaint. It is unlikely we would find fault in the Council’s noise investigation, and the Housing Ombudsman deals with complaints about the Council’s role as a social housing provider.

  • London Borough of Bromley (19 006 346)

    Statement Upheld Noise 25-Feb-2020

Summary: Ms B complains about the Council response to her noise nuisance complaint. She says this caused her an injustice because the noise affected her quality of life. The Ombudsman finds fault with the Council because it delayed in identifying and responding to the statutory noise nuisance. The agreed actions remedy the injustice caused to Ms B.

    Statement Not upheld Noise 21-Feb-2020

Summary: There is no evidence of fault in the Council’s handling of a noise nuisance, under both its environmental health and planning enforcement powers. For this reason, the Ombudsman has completed his investigation.

There was no fault in how the Council consulted on, and reached the decision to approve the planning application, or in the way it investigated and responded to their complaints of noise and light glare.

  • Stevenage Borough Council (19 016 121)

Statement Closed after initial enquiries Noise 20-Feb-2020

Summary: The Ombudsman will not investigate Mr X’s complaint about the Council’s decision that his neighbour is not causing him noise nuisance. This is because there is insufficient evidence of fault by the Council and the Ombudsman cannot investigate late complaints without good reason to do so.

  • South Cambridgeshire District Council (18 018 328)

    Statement Not upheld Noise 20-Feb-2020

Summary: Mrs X complains the Council has failed to take action to stop noise nuisance, vibrations and air pollution from nearby roadworks. The Council is carrying out regular monitoring of the effects of the roadworks. It is also using its regulatory powers to ensure best working practice. The Council has used its professional judgement to determine there is no basis to take formal action.

  • South Holland District Council (19 012 763)

Statement Closed after initial enquiries Noise 19-Feb-2020

Summary: The Ombudsman will not investigate Mrs X’s complaint that the Council has failed to properly deal with her complaints of noise nuisance. Any complaint about the Council’s actions prior to October 2018 are late and it is unlikely we would find fault in the Council’s decision not to take formal action.
