    Summary: Mrs D complains there were flaws in the procedure followed by a school admission appeal panel. We uphold the complaint finding the panel did not take account of information which it mistakenly believed Mrs D had not provided. It said this was “crucial” to the appeal. We consider this oversight may have affected the outcome of the appeal. We therefore recommend the Council arrange a further appeal.

The Council has now remade its decision and agreed to apologise to Mrs X and pay her £100.

    Summary: Miss X complains about the process the Council followed in arranging a school admissions appeal panel. Based on the evidence currently available, the Ombudsman has found fault in how the Council recorded the events of the appeal panel hearing and in its late decision to award Miss X’s daughter medical priority. Only the latter fault caused injustice, in the form of uncertainty, and the Council has agreed to arrange a new appeal panel hearing to resolve this.

This did not cause injustice to Mrs F because the panel was still able to consider her appeal without fault. The School has agreed to amend its procedures to address the faults identified.

The Panel did not explain its decision adequately and has not demonstrated that it dealt properly with the question of the address used for the application for a place. This was a key point in deciding whether the Council had applied the admission arrangements properly. The Council has agreed to arrange a fresh hearing. It has started a review of its practice on writing appeal decision letters. This is a suitable remedy.
