Summary: The Ombudsman will not investigate Mr B’s complaint about the Council’s conduct at a business rates court hearing and about additional charges the Council applied to his account. • London Borough of Camden (19 004 240)

Statement Closed after initial enquiries Other 29-Jul-2019

Summary: Mr B complains about the Council and the Valuation Office Agency (VOA) concerning matters relating to his company’s liability for business rates. The Ombudsman will not investigate the complaint because the VOA is a central government agency and not within our jurisdiction and the availability of appeal rights to the Valuation Tribunal places the complaint against the Council outside our jurisdiction.

  • Birmingham City Council (18 013 557)

    Statement Upheld Other 26-Jul-2019

Summary: Mr B complains about how the Council has communicated with the Valuation Office Agency about whether his properties should be liable for business rates, rather than council tax. And about the enforcement action the Council has taken. The Ombudsman’s view is the Valuation Office Agency decides liability. And it is not within the Ombudsman’s jurisdiction. We do find some fault with the enforcement action and have agreed remedies with the Council. But the faults did not lead to Mr B’s claimed injustice.
