    Summary: The Ombudsmen found fault by a Council’s social care assessment process and the support provided to a carer. The Council has already accepted the fault and agreed to pay £300 to recognise the anxiety and distress caused by the fault. The Ombudsmen has not found fault by an NHS Trust relating to the mental health support it offered. There was no fault with the Council’s complaint handling.

    Summary: The Ombudsmen found fault by the Trust as it delayed in arranging for the complainant’s social care needs to be assessed and did not refer her to the primary care mental health service. The Trust agreed to apologise to the complainant and pay her a financial remedy in recognition of the distress this caused. The Ombudsmen are satisfied the social care assessments the Council eventually carried out were appropriate and in keeping with the requirements of the Care Act 2014.

    Summary: The Ombudsmen have stopped investigating Mr A’s complaint about the choice of legal powers applied to his late mother, Mrs B, in hospital following her detention under Section 2 of the Mental Health Act. This is because they could not achieve the outcome Mr A wants. There is a more appropriate route for Mr A to pursue in relation to Mrs B’s Continuing Healthcare funding.

Although I cannot say this affected the care she received, this has led to uncertainty and has had an emotional impact. The Council and Trust have agreed to pay Ms V £500 to remedy the injustice caused.

    Summary: Worcestershire Health and Care NHS Trust’s community mental health team took too long to rearrange a cancelled appointment. Also, it did not return Mrs A’s call after she raised concerns about her son’s mental health. This caused Mrs A distress. The Ombudsmen consider Worcestershire County Council and the community mental health team’s lack of communication after April 2015 was fault. However, there was no impact on Mr B.
