Statement Not upheld Hospital acute services 09-May-2019
Summary: The Ombudsmen has not found fault by a Council, an NHS Trust or a CCG with their assessment and/or consideration of continuing healthcare funding. The Ombudsmen found fault by a GP Practice in not considering fast-tracking a continuing healthcare assessment. The Practice has already accepted the fault and taken action to learn from the complaint. A retrospective continuing healthcare review which the CCG has agreed to will remedy any potential financial injustice.

Statement Upheld Hospital acute services 09-May-2019
Summary: The Ombudsmen consider the Aintree University Hospital NHS Foundation Trust did not tell the family Mr B fell on a high visibility ward in March 2016. Also, it did not fully consider Mr B’s views in a best interest decision despite his fluctuating capacity. Sefton Metropolitan Borough Council did not tell Mr B’s family he would be an ordinary resident of Liverpool if moved out of the region. Liverpool City Council’s lack of assessment of Mr B’s needs caused confusion and distress to Mr B’s family. We have made recommendations to address the family’s injustice.

Summary: Mr P complained about his mother-in-law Mrs D’s discharge from hospital, about how the Council arranged her social care, and about the way his complaint was handled. The Ombudsmen find fault with the way the Trust and Council arranged Mrs D’s hospital discharge, with the Council’s actions following this, and with the way the complaint was handled. The Trust and Council have agreed to take action to remedy the injustice this caused.

Lincolnshire Partnership NHS Foundation Trust (17 014 253c)
Statement Not upheld Hospital acute services 29-Apr-2019
Summary: The Ombudsmen do not consider Northern Lincolnshire & Goole NHS Foundation Trust’s (the Trust) decision to remove M from the watchful wait list in January 2017 was fault. However, the Trust should have told Miss L it removed M from the watchful wait list in July 2016, before it later reinstated him. The Ombudsmen do not consider the Trust unnecessary delayed sending M for an autism assessment. Also, Lincolnshire Partnership NHS Foundation Trust’s autism assessment of M was in line with the relevant guidelines.

Summary: The Ombudsmen find Council-arranged domiciliary carers did not complete an adequate plan to help prevent a vulnerable person from getting pressure sores. The lady did develop painful pressure sores and it is likely better planning could have helped prevent them. Further, the Ombudsmen find both a Council and a hospital Trust failed to communicate effectively about a safeguarding concern. As a result, adequate investigations did not take place. The Council and Trust have agreed to apologise and make small financial payments to address the injustice.

Summary: The Ombudsmen will not investigate Ms D’s complaint about the treatment and care provided to her late friend, Mr Y during his final admission to hospital. This is because the Trust and Council have investigated and taken appropriate steps to resolve the complaint. It is unlikely that an investigation by the Ombudsmen could add anything further.
