We cannot seek an apology for comments made by a care home manager to Mrs X during a conversation. Neither can we pursue Mrs X’s wish for assurances she can continue to visit people in the care home not related to her.

    Summary: Mr X complains that individuals from the care home next to his property are throwing items into his garden. He says the incidents could have led to him and his wife becoming injured and they now fear using their garden. He states their health and wellbeing has also been affected and wants the matter resolved. The Ombudsman will not investigate Mr X’s complaint. This is because we only investigate complaints about care providers which relate to the provision of care.

    Summary: The Ombudsmen find a Council at fault for an avoidable delay in arranging a patient’s discharge from hospital. As a result the patient did not get home and suffered avoidable frustration, as did her son and his wife. The Council agreed to provide an apology, a small payment to recognise the avoidable frustration, to repay any care contributions the patient should not have paid, and to take action to prevent recurrences.

    Summary: Mr B has complained about the handling of his daughter C’s adult care review and the lack of one-to-one provision for her for late night access to the community. The Ombudsman considers that the provision of an additional five hours one-to-one support to C and the apology given to Mr B are suitable remedies for the injustice caused to them.

    Summary: Ms X complained about how long the Council took to make an application to the Court of Protection to sell her share of her former home. This has caused her unnecessary expense. The Ombudsman has found there has been some avoidable delay that has caused Ms X an injustice. To remedy this, the Council has agreed with the Ombudsman’s recommendation to apologise and cover Ms X’s rent for some of this time.

    Summary: Mrs X complained the Council failed to ensure her son’s care provider gave him the level of care needed. She said her complaint about poor care resulted in his eviction from a placement with the Hollybank Trust. The Clinical Commissioning Group and the Hollybank Trust have not yet had the opportunity to respond to Mrs X’s complaint, therefore, the Ombudsmen have discontinued their investigation.

    Summary: Miss X complained about the Council damaging tiles in her mother’s bathroom when it installed a shower seat. We propose not to investigate this complaint. Claims for damage to property are for the courts to consider, and it is reasonable for Miss X to apply to the court on her mother’s behalf.
