It cancelled Mr Y’s day service at short notice, failed to provide alternative support, and failed to respond to a crisis situation whilst Mr Y was in residential respite care. Consequently, the placement broke down. The impact on Mr Y’s wife was significant.

    Summary: Ms X complains the Council has failed to address her concerns properly about its handling of her care needs and failed to provide a satisfactory remedy for the injustice it has caused. The Council identified the need for help with medication seven days a week but only provided this five days a week. The Council needs to apologise and provide financial redress.

The Ombudsman finds the Council delayed completing a care assessment and failed to follow its complaints policy. The Ombudsman recommends the Council provides an apology to Mr X, pays Mr X £300 and takes steps to prevent recurrence of the faults.

    Summary: The Ombudsman has not found evidence of fault in the way the Council decided to change Mr C’s support arrangements. However, the Council’s failure to complete a formal care plan and a carer’s support plan was fault. There was also no fault in the Council’s agreement that Mr C should live with his brother during an emergency placement, but the Council should have obtained Mr C’s views earlier and helped him in accessing his adapted facilities. The Ombudsman recommends the Council provides a care plan and a carer’s support plan, apologises to the family and pays them £200.

    Summary: Mr and Mrs C complained about the way in which the Council carried out Ms M’s financial assessment for residential care. They say the Council should not have included a value for Ms M’s share in a property and it took too long before the Council provided a response to their appeal. The Ombudsman found fault with the way in which the Council processed the appeal, which resulted in avoidable delay and distress. However, the Council acted correctly by getting an independent valuation of Ms M’s share.

    Summary: Ms C complains the Council failed to carry out a carer’s (re)assessment of her in 2019, as a result of which she has not received the funds she need to pay for her yoga classes and some employment related training she identified. The Ombudsman found there was no fault in the actions of the Council.
