    Summary: Mr X complains the Council failed to consider properly noise complaints from him and his partner and the Council withdrew abatement notices inappropriately. We found the Council reached these decisions properly. Mr X also complained about the way the Council handled the investigation. We found there was fault in the way the Council agreed noise testing with those responsible for the noise. The Council agreed to pay £100 to Mr X to remedy his injustice.

We do not uphold this complaint. We consider there is no fault in the Council giving the business a dog breeding license despite the planning enforcement notice. We also consider it reasonable for the Council not to have taken planning enforcement action given all the circumstances of the case.

    Summary: Mrs X complained the refuse collectors were not putting her bins back when they were emptied. The Council was at fault. It has already apologised and monitored the waste collections. It will remind the waste collection team of the need to sustain their improved performance. The action the Council has already taken and intends to take is an appropriate remedy for the injustice caused.

    Summary: Ms B complains about the service and information provided by the Council in connection with her parents’ memorial plaque. The Ombudsman will not investigate the complaint because it is unlikely we can add to the investigation already carried out by the Council and an investigation is unlikely to lead to a different outcome.

    Summary: Mr C complains about the Council’s failure to take action about noise nuisance  from events at a community centre next to his home. Mr C says the noise is both a statutory noise nuisance and a breach of the lease agreement with the Council. Mr C also says the Council has not complied with the recommendations made by the Ombudsman in response to his previous complaint about the same issues.
