Examples where the matter is IN jurisdiction

  • The complainant lives in a police house, and the police authority have not repaired a broken boiler
  • The fire authority wrongly gave a fire certificate to the B&B hotel in which the complainant has been living, without making a proper inspection and the building is allegedly still potentially dangerous
  • The Environment Agency, when consulted about a proposed development on a flood plain, said that it had no objections and as a result, the council approved the plans. The development is in place and the complainant’s home, which was not previously flooded, now experiences flash flooding when the river is high (but see 26(6)(c))
  • The joint highways committee of the city and county council has refused permission for a residents’ parking scheme within the city
  • The complainant’s son has been excluded from school, and the appeal panel did not fully consider the true facts
  • The complainant appealed unsuccessfully for a place at a local church school, and the appeal panel did not allow the complainant a proper hearing, if the school is either run by the LEA or voluntary aided (supported by the LEA)
  • The LEA (or school governors for a voluntary aided school) did not properly apply the school’s admission criteria
  • The council has placed the names of the complainant’s children on the Child Protection Register

Examples where the matter is OUTSIDE jurisdiction

  • The Environment Agency has not dealt properly with pollution of the local watercourse
  • A complainant who was temporarily living and working in an EU country complained that the council had only put second class postage on his postal voting form, so that it arrived too late for him to make use of it
  • A postal voting form was lost in the post
  • A candidate for council elections filled in the postal voting form but did not vote for the complainant’s choice of candidate
  • The complainant has had his water cut off because he was unable to pay the bill
  • The parish council did not object to a local planning application, even though many villagers spoke against it
  • The parish council says it will not support our request for the county council to put traffic calming measures in our village
  • The parish council does not keep proper and transparent accounts
  • A child protection conference decided to continue to monitor suspected child abuse by the complainant although the evidence indicates that the complainant has not abused children in the past (but there may be matters relating to social workers’ involvement in the investigation and up to the door of the meeting which are within jurisdiction)
