The complaint

A man complained an officer of the council improperly used knowledge gained through his employment for his personal advantage and to the man's detriment. It then failed to properly investigate the allegations.

Finding

The Ombudsman upheld the complaint and found fault causing injustice.

Recommendations

To remedy the injustice, we recommend the council:

  • apologise to the man within one month of our final decision
  • pay a charity nominated by the man £250 within one month to acknowledge the difficulties and uncertainty caused by the faults, and
  • review the process by which the council investigates complaints of serious misconduct against its officers to ensure in future it responds properly. As confirmation of the review it should send us a copy within three months of the date of the report.
