Planning applications                 Maladministration causing injustice

22 May 2008

King’s Lynn and West Norfolk Council failed to pick up an inaccuracy on plans submitted with a planning application for a new house. The Ombudsman said that this led to permission being granted for a house that extended four metres further beyond the back of a neighbour’s home than should have been the case.

‘Mr Dee’ (not his real name for legal reasons) complained about the way the Council granted planning permission for a new detached dwelling next door to his home.

The Ombudsman found that the Council failed to appreciate the relationship between the proposed dwelling and Mr Dee’s property. As a result, it granted permission for a house that extended four metres further beyond the rear of Mr Dee’s home deeper than would have been the case if an error on the plans been picked up on a site visit.

Remedy

The Ombudsman found maladministration causing injustice and recommended the Council to:

  • arrange for the District Valuer to carry out valuations of Mr Dee’s home as it was and as it would have been had the fault not occurred, and pay Mr Dee the loss in value, if any;
  • pay Mr Dee £250 for his time and trouble in pursuing his complaint; and
  • review its training and supervision arrangements for unqualified planning assistants charged with conducting site visits on planning applications.
