Planning applications Maladministration causing injustice

King’s Lynn and West Norfolk Council failed to pick up an inaccuracy on plans submitted with a planning application for a new house. The Ombudsman said that this led to permission being granted for a house that extended four metres further beyond the back of a neighbour’s home than should have been the case. ‘Mr Dee’ (not his real name for legal reasons) complained about the way the Council granted planning permission for a new detached dwelling next door to his home. The Ombudsman found that the Council failed to appreciate the relationship between the proposed dwelling and Mr Dee’s property. As a result, it granted permission for a house that extended four metres further beyond the rear of Mr Dee’s home deeper than would have been the case if an error on the plans been picked up on a site visit.
Remedy
The Ombudsman found maladministration causing injustice and recommended the Council to:
