Land Maladministration causing injustice
28 September 2005
‘Mr Jones’ (not his real name for legal reasons) complained that the Council had failed to consult the public properly before seeking to dispose of Elvaston Castle Country Park. He was concerned that public access to the park would be reduced.
The Ombudsman found that the Council’s consideration of the future of the Elvaston Country Park Estate had taken several years and was still not complete. She said this was inevitable when disposal of such a large area of land is concerned and where private investment is being sought.
Her investigation found no maladministration in the way that the Council dealt with any intended disposal of the land. She also acknowledged that Mr Jones had provided a comprehensive dossier of information to support his views, and this had enhanced the understanding of the issues.
