Housing repairs                            Maladministration causing injustice

Concerns about Basildon District Council’s ability to complete housing repairs in a timely and effective manner were again highlighted by the Ombudsman. He said that after he had issued a critical report in April 2007, the Council had told him it had implemented measures to ensure it provides a responsive repair service for its tenants.

He commented “The fact that I have cause to issue a further report a year on would indicate that those measures are not proving wholly effective.”

‘Mr and Mrs Champion’ (not their real names for legal reasons) were council tenants who experienced a number of leaks from the roof and balcony into their home. They reported these to the Council on a number of occasions, but contractors failed to attend or to complete effective repairs. The delays in attending to the repairs totalled 15 months.

The Ombudsman found maladministration causing injustice. The delays in completing repairs were unacceptable and greatly affected Mr and Mrs Champion’s ability to enjoy living in their home. Also, the time and trouble they had to take trying to get the Council to resolve the leaks was excessive.

Remedy

The Council, after involvement from the Ombudsman’s office: 

  • completed satisfactory repairs to the roof, balcony and porch;
  • redecorated the living room to make good the damage caused by repeated leaks;
  • agreed to pay Mr and Mrs Champion £1,500 compensation; and
  • undertook to review its processes once again in a bid to help improve the responsiveness of its repairs service for its tenants.
