Environmental health                 Maladministration causing injustice

A residents’ association complained about the Council’s management of its tenants’ operations at Plymouth City Airport. It alleged that the Council, as ground landlord of the airport, has failed to manage the operations of its tenants, in particular noisy helicopter operations and engine testing, and that it has failed to act on the findings of a Government review of the future of air transport.

The Ombudsman upheld some of the association’s allegations. He finds maladministration causing injustice and recommends the Council to:

  • urgently reconsider whether directions on the airport operators have been complied with and, if not, take action to enforce the directions;
  • urgently take legal advice on its interpretation of a planning condition restricting use of a runway at the airport and, if necessary, take action to enforce the condition;
  • take prompt and effective action to control nuisance caused to local residents by engine testing;
  • make payments to members of the residents’ association who have been significantly disturbed by noise from naval helicopter operations and engine testing; and
  • pay the residents’ association £500 for its time and trouble in making this complaint.
