Special educational needs        Maladministration causing injustice

‘Ms Garnet’ (not her real name for legal reasons) has a son with special educational needs. She was concerned that the Council had failed to find a suitable school for him and had declined to provide him with an escort to and from school.

The Ombudsman was critical of the Council on both counts. She found maladministration in the way the Council communicated with Ms Garnet and, in some respects, how it administered the overall situation. However, she was not persuaded that the level of resulting injustice was as much as Ms Garnet believed.

The Council has agreed to apologise to Ms Garnet and pay her £750 to account for the needless confusion and worry that arose at a very difficult time for her. The Ombudsman sees that as a satisfactory resolution and calls for no other action other than for the Council to draw the relevant lessons and to let her know what it proposes to do.
